For Immediate Release: DISH Mayor Calvin Tillman and Affected Property Owner Tim Ruggeiro, Co-Founders of ShaleTest.org, Will Be Touring the Marcellus Shale.

DISH, TX -- DISH mayor Calvin Tillman and affected Wise County property owner Tim Ruggiero will be touring the Marcellus Shale discussing ShaleTest.org, a non-profit environmental testing organization co-founded by the two.

Last fall the formation of ShaleTest was announced in Fort Worth. Since the announcement, the ShaleTest Board of Directors have been working on building the non-profit in an effort to to provide environmental testing to lower income families. DISH mayor Calvin Tillman says that "this will be my fourth trip to the Marcellus Shale and it will be great to announce ShaleTest to that area, it is our goal to have a permanent presence in this region soon ".

Co-Founder Tim Ruggiero says "I have seen first hand the damage caused by drillers motivated more by profit than any attempt at being a Good Neighbor. Some drillers are reckless, cut corners and simply do not follow the law. Self-regulation and self-reporting are not working. Where there is no responsibility, there is no accountability. We need to drill, and we need the energy-but it needs to be done responsibly, with respect to people and their private property. I am excited to join Mayor Tillman on the 2011 Truth Tour on the Marcellus Shale."
Board of Directors member Susan Knoll says "ShaleTest is here to help those people in gas-developing communities who are unable to help themselves".

Bill Aimed at Taking Away Municipal Permitting Authority for Drilling Operations in Texas

The bill below would essentially take away permitting authority for local governments in Texas. Please call your legislators. 82R5223 PMO-D By: Keffer H.B. No. 3105 A BILL TO BE ENTITLED AN ACT relating to the applicability of the Private Real Property Rights Preservation Act to certain governmental actions. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 2007.003(a), Government Code, is amended to read as follows: (a) This chapter applies only to the following governmental actions: (1) the adoption or issuance of an ordinance, rule, regulatory requirement, resolution, policy, guideline, or similar measure; (2) an action that imposes a physical invasion or requires a dedication or exaction of private real property; (3) an action by a municipality that: (A) has effect in the extraterritorial jurisdiction of the municipality, excluding annexation, and that enacts or enforces an ordinance, rule, regulation, or plan that does not impose identical requirements or restrictions in the entire extraterritorial jurisdiction of the municipality; or (B) damages, destroys, impairs, or prohibits development of a mineral interest; and (4) enforcement of a governmental action listed in Subdivisions (1) through (3), whether the enforcement of the governmental action is accomplished through the use of permitting, citations, orders, judicial or quasi-judicial proceedings, or other similar means. SECTION 2. The change in law made by Section 2007.003(a), Government Code, as amended by this Act, applies only to an action the effective date of which occurs on or after the effective date of this Act. An action the effective date of which occurs before the effective date of this Act is covered by the law in effect when the conduct occurred, and the former law is continued in effect for that purpose. SECTION 3. This Act takes effect September 1, 2011. this.window.focus();

Speaking Events

I will be on a panel at the Society of Business Editors and Writers annual conference on April 8, 2011 at 3:45 PM. The panelist will include: David P. Poole, a Senior Vice for Range Resources Corporation; Prof. Tad Patzek, Chairman of the Petroleum and Geosystems Engineering Department at The University of Texas at Austin, who has testified before Congress in connection with the Deep Water Horizon disaster; Elizabeth Souder, energy writer for the Dallas Morning News, and myself. This will be held at Southern Methodist University and I do not believe it is open to the public I will also be speaking 16170 Horseshoe Dr, Gardendale, TX (just outside of Odessa) in the heart of the storied Permian Basin on April 9, 2011. Hot dogs and soft drinks start at 5:00 PM. Tim Ruggeiro and myself will be touring the Marcellus Shale again from April 24th through May 1st. Watch www.shaltest.org for the complete schedule.
